Daughter blames roofing contractor for father's death

MOUNDSVILLE — A Maryland woman is suing contractors and a building owner, alleging wrongful death and breach of duty of care.

Wendy Stephanie Lara Caballero of Prince George's County, Maryland, daughter of decedent Jose Arturo Caballero Guzman,  filed a complaint in Marshall Circuit Court against Balmory Posada, doing business as Posada Contractor, Daily Roofing Inc, United Electric Wheeling Inc. and Reilley's Inc, alleging failure to implement all required safety measures in violation of multiple state and/or federal regulations.

According to the complaint, on Oct. 10, 2016, while working on the roof at 1307 Wheeling Ave.,Glen Dale, Guzman fell approximately 20 feet through an opening where Posada had removed an old metal pane to install a new metal roofing panel. The opening was approximately 3 feet by 35 feet. The fall killed Guzman. 

According to the suit, his death resulted from the defendants failure to provide any form of fall protection or safety training.

The plaintiff alleges holds the defendants had a duty to warn Guzman of any concealed dangers and the duty to use due care.

Wendy Stephanie Lara Caballero seeks trial by jury, damages to fully and reasonably compensate her, the estate of Jose Arturo Caballero Guzman and wrongful death statutory beneficiaries of the decedent. She also seeks court costs, expenses, attorney fees, punitive damages, and pre- and post-judgment interest. She is represented by attorneys James G. Bordas III and J. Zachary Zatezalo of Bordas & Bordas PLLC in Wheeling.
