Insurer seeks to recover $22,000 from transport company

WINFIELD — An Insurance company is suing a Kansas transportation service company and a Tennessee resident, alleging negligence caused a crash with one of the plaintiff's clients.

Penn National Insurance Group filed a complaint in Putnam Circuit Court against Butler Transport Inc. of Kansas City, Kansas, and driver Kevin Morrow, alleging the Tennessee resident negligently drove the vehicle owned by Butler Transport.

According to the complaint, on Aug. 16, 2016, Penn National Insurance's insured client Joy Jordan Hertel was operating her vehicle on Interstate Highway 64 in Putnam County. The suit says Morrow caused his vehicle to collide with Hertel's car. 

The lawsuit states Hertel was paid by Penn National pursuant to the insurance contract. The plaintiff alleges Morrow operated the vehicle in a grossly negligent and reckless manner.

Penn National Insurance seeks trial by jury, an amount of $22,750.01, pre-judgment and post-judgment interest, attorney fees, cost of court and any further just relief. It is represented by attorney Clinton W. Smith of Charleston.
