Towing service alleges Bluefield, police department breached contract

PRINCETON — A towing service is suing Bluefield and its police department, alleging breach of implied contract, denial of due process, and wrongful and improper denial of a valid Freedom of Information Act request.

Tow Pro Towing LLC filed a complaint in Mercer Circuit Court against the City of Bluefield, the Bluefield Police Department and police chief Dennis Dillow, alleging they wrongfully terminated the plaintiff’s service as a towing provider.

According to the complaint, between April 9, and July 6, Tow Pro Towing was removed without prior notice from the list of companies to be contacted/dispatched by the Bluefield Police Department for towing services. The suit says Two Pro requested from the Bluefield city clerk, the opportunity to inspect or copy Bluefield Police Department's records, including written and documented policies and procedures relating to the dispatching of towing services. 

The plaintiff alleges the defendants removed Two Pro's services without due process of law and have ignored the records request

Tow Pro Towing seeks trial by jury, compensatory damages, punitive damages, injunctive relief, pre- and post-judgment, attorney fees and costs of suit. It is represented by attorney Stephanie A. Pfeifer of The Ratliff Law Firm in Bluefield.
