HUNTINGTON — A Huntington man is suing a van driver and his employer, alleging negligence caused the plaintiff to be run over.

Phillip Burks filed a complaint in Cabell Circuit Court against Jeffrey King and Chambers Holdings Corporation, alleging King struck the plaintiff while he was crossing the street in the 900 block of Fourth Avenue in Huntington.

According to the complaint, on March 16, 2017, as Burks was crossing the street, he was hit by King who was driving Chambers Holdings' 2010 Ford Cargo van. The suit says Burks He was knocked off the ground and sustained serious injuries. 

The plaintiff alleges King was inattentive and reckless. Furthermore, the suit alleges, Burks was walking in a designated crosswalk.

Burks seeks trial by jury, compensatory damages, pre-judgment interest, post-judgment interest, court costs, attorney fees and all other just and proper relief. He is represented by attorney Kenneth P. Hicks of Huntington.
