Discharged employee alleges DirecTV unit failed to timely pay wages

CHARLESTON — A Cabell County man is suing a DirecTV unit, alleging violation of workers compensation acts.

Eric McComas filed a complaint in Kanawha Circuit Court against DirecTV Customer Services Inc. and DirecTv LLC, alleging they violated the West Virginia Wage Payment and Collection Act.

According to the complaint, after McCormas was employed DirecTV for more than eight years, the defendant involuntary terminated his employment May 7, 2015, but McCormas did not receive his final check until May 15, 2015. 

The plaintiff alleges the defendants failed to pay all wages owed in full within 72 hours of his discharge.

McComas seeks trial by jury, damages of more than $75,000, plus liquidated damages, attorney fees, court costs and interest. He is represented by attorneys Michael P. Adair and Todd S, Bailess of Bailess Smith PLLC in Charleston.
