CHARLESTON — A Charleston GMC Yukon owner is suing a St. Albans car dealer, alleging unlawful sales practices and negligent misrepresentations.
Bethany Watts filed a complaint in Kanawha Circuit Court against Moses C&O Chevrolet, alleging the dealer sold her a defective GMC Yukon.
According to the complaint, on May 16, 2016, Watts purchased a 2012 GMC Yukon from the defendant. The suit says Watts began experiencing mechanical issues shortly after the purchase.
She allegedly was told by the defendant that there was nothing wrong with the car even with the numerous issues she encountered, apart from a thumping and kicking in the rear of the vehicle, which makes her afraid to drive the Yukon.
During the past two years, the lawsuit states the vehicle continued manifesting issues with the defrost shocks, driver side doors, and traction control. The plaintiff alleges Moses C&O Chevrolet never disclosed the defects and failed to honor its warranty for the goods purchased and mishandled the administration of the warranty.
Watts seeks trial by jury, compensatory damages in excess of the jurisdictional limits of the court, plus costs of suit, attorney fees and all other just and proper relief. She is represented by attorney Michael M. Cary of Cary Law Office PLLC in Charleston.
