Glascow Health Rehabilitation Center blamed by daughter for her father's death

CHARLESTON — The daughter of a nursing home resident has filed a wrongful death claim against Glascow Operating Co., doing business as Glascow Health Rehabilitation Center, and several Savaseniorcare companies.

Trudy J. Boothe filed a complaint in Kanawha Circuit Court against the defendants alleging that they failed to provide for Albert D. Boothe's basic needs.

According to the complaint, the plaintiff alleges that between Oct. 13 and 18, 2017, Albert D. Boothe had a choking incident that caused hypoxic brain injury and acute hypoxic respiratory failure secondary to cardiac arrest. 

The plaintiff incurred medical expenses for the incident, which led to his death. The plaintiff holds the defendants responsible for allegedly failing to provide Albert D. Boothe with adequate supervision, assistive devices and an environment free of hazards to prevent accidents. In addition, they failed to provide the sufficient number of staff to deliver adequate and appropriate nursing care to all their residents.

The plaintiff requests a trial by jury and seeks all damages allowable under West Virginia law, including punitive damages, attorney's fees and other relief the court may deem fit. She is represented by Jeff D. Stewart, Andrew L.Paternostro and S. Andrew Stonestreet of Stewart | Bell PLLC in Charleston, WV.
