Allstate sued after fire damages home

CLARKSBURG — A homeowner is suing Allstate Indemnity Co. and Jeffrey M. Daniels, insurer, citing alleged bad faith, breach of contract, and vicarious liability.

Daniel Jones filed a complaint in U.S. District Court for the Northern District of West Virginia against the defendants alleging that they breached its duty of good faith and fair dealings.

According to the complaint, the plaintiff alleges that, on July 9, 2016, he was subjected to financial hardships, delay, embarrassment, annoyance, and inconvenience, and suffered extensive damages to his property, located at 207 Suncrest Boulevard in Fairmont, West Virginia, which caught fire while the structure was insured by the defendant. However, the defendant denied paying the remaining 50% of the property's insurance coverage. 

The plaintiff holds Allstate Indemnity Company and Jeffrey M. Daniels responsible because the defendants allegedly forced plaintiff to obtain the assistance of a legal counsel, failed to to conduct reasonable investigation of all aspects of plaintiff's claims, failed to confirm coverage of plaintiff's claims, and failed to protect plaintiff's assets.

The plaintiff requests a trial by jury and seeks judgment against defendant for compensatory and punitive damages, order defendant to provide a detailed accounting of all payments, interest, attorney's fees and further relief as the court may deem just. He is represented by Daniel Jones of Summers & Associates in Parkersburg.
