Construction equipment supplier alleges drilling business owes $7,400

BECKLEY — A construction equipment supplier is suing a drilling and blasting company, alleging unjust enrichment.

Cecil I. Walker Machinery Company filed a complaint in Raleigh Circuit Court against Beckley Drilling & Blasting Services, alleging the defendant failed to liquidate its balance due and owing of $7429.80.

According to the complaint, Cecil I. Walker Machinery provided goods and services to Beckley Drilling but has not received payment despite due demand. The plaintiff allleges Beckley Drilling & Blasting Services purchased and accepted goods/services from Walker Machinery but has failed to submit payments.

Cecil I. Walker Machinery seeks the $7,429.80 and interest at the rate of 18 percent from Jan. 31, 2018, and interest at the statutory rate of 4.5 percent from the date of judgment, plus court costs and all other proper relief. It is represented by attorneys Gregory A. Stout and James P. Tomasik of Reisenfeld & Associates LLC in Cincinnati.
