Charleston man alleges Ford sold defective vehicle

Owen J. Stout filed a complaint in Kanawha Circuit Court against Ford Motor Company, alleging the automobile company failed to provide a vehicle that was fit for its intended use.

According to the complaint, on Sept. 16, 2017, Stout purchased a new 2017 Ford Escape SE. Between then and July 10, 2018, the suit says, Stout experienced nonconformities with the vehicle, including the check engine light, engine failure, malfunctioning air conditioning and noise under the vehicle. 

The lawsuit states the Ford Escape SE has undergone two warranty repair attempts but it was rendered substantially impaired and has not been utilized for its intended purposes. 

The plaintiff alleges Ford Motor Company is bound by all warranties implied by state law and has failed to effectuate repairs within a reasonable amount of time.

Stout seeks trial by jury, the contract be declared canceled by rejection, recission or revocation of acceptance. Stout further seeks consequential damages and/or incidental damages, court costs and attorney fees, plus pre- and post-judgment interests.
