WHEELING — A Cincinnati covering distributor is suing a Wheeling carpet center, alleging breach of contract.
CDC Distributors Inc. filed a complaint in Ohio Circuit Court against Michael Contraguerro Sr., doing business as Carpet Showcase Flooring Center, alleging the defendant has a balance due and owing of nearly $11,000.
According to the complaint, Carpet Showcase has a balance of $10,873.98 as of Jan. 29, which remains due and owing to CDC for the goods, wares, and merchandise delivered to the defendant upon the latter's request.
The plaintiff alleges Carpet Showcase Flooring Center has accepted the goods but has willfully failed and refused to pay the balance despite repeated requests from the plaintiff.
CDC Distributors seeks $15,694.48, with continuing interest on the principal balance at the rate of 18 percent per annum, court costs and attorney fees. It is represented by attorney Arch W. Riley Jr of Bernstein-Burkley PC in Wheeling.
