Former employee accuses facial surgery business of retaliation

CHARLESTON — A former employee is suing a facial surgery practice, alleging retaliation and violation of the West Virginia Human Rights Act.

Kelli M. Bails of Putnam County filed a complaint in Kanawha Circuit Court against Drs. Krajekian, Brock & Henderson Inc., doing business as Mountain State Oral & Facial Surgery, Dr. Jack I. Krajekian and Dr. John Brock, alleging wrongful termination. 

According to the complaint, Bails was fired by the defendants Aug. 16, 2017. She says has suffered lost wages and benefits, damages for indignity, embarrassment and humiliation. Bails alleges she was demoted and then terminated, from her positions as chief operating officer and director of business development for doing her job in reporting incidents of inappropriate staff conduct. 

The plaintiff alleges the defendants acted with reckless disregard and/or indifference to the Bails' rights and retaliated by demoting her and then terminating her employment for performing what her position dictated.

Bails seeks trial by jury, lost wages and benefits, back pay, front pay, punitive damages, interest, attorney fees, court costs, injunctive relief and all further just relief. She is represented by attorneys Todd S. Bailess, Rodney A. Smith and Jeffrey A. Foster of Bailess Smith PLLC in Charleston, West Virginia.
