Driver seeks damages from UPS Store over Daniels collision

BECKLEY – A woman alleges she was injured in an auto accident in Daniels when a UPS Store vehicle collided with hers.

Sarah Hudnall filed a complaint in Raleigh Circuit Court against John Adkins and J & L Adkins Inc., doing business as The UPS Store, alleging negligence and vicarious liability.

According to the complaint, on Nov. 2, 2016, the plaintiff was driving her 2011 Nissan Rogue northbound on Ritter Drive in Daniels. She alleges she slowed down and ultimately stopped near the entrance of the Glade Springs Resort to yield to other motorists who were stopped in front of her. The suit states Adkins failed to stop the J &L Adkins-owned 2015 Ford F-150 truck he was driving and rear-ended the plaintiff, causing her to sustain injuries.

The plaintiff holds Adkins and J & L Adkins Inc. responsible because Adkins allegedly followed the plaintiff's vehicle too closely and failed to control his speed.

The plaintiff seeks compensatory damages, punitive damages, prejudgment and post-judgment interests, attorneys' fees, costs and expenses. She is represented by Robert D. Cline Jr. and Brian E. Bigelow of Farmer, Cline & Campbell PLLC in Beckley.

The case has been assigned to Circuit Judge H.L. Kirkpatrick III.
