BECKLEY – A mining products company alleges a Kentucky corporation doing business in Fayette and Raleigh counties failed to pay it for labor and supplies.
Raleigh Mine and Industrial Supply Inc. filed a complaint in Raleigh Circuit Court against C.W. Coal Sales Inc. alleging failure to pay.
According to the complaint, the plaintiff alleges that in June, it was asked by C.W. Coal to provide labor and materials for work/improvement to a real property on which the latter was conducting operations. The plaintiff alleges it provided the labor and materials on an open account and the defendant has failed to pay unpaid and past-due invoices.
The plaintiff seeks an amount of $58,901.59, pre- and post-judgment interests at appropriate rates on the unpaid balance until paid, costs, attorney's fees and other relief the court deems fair and appropriate. It is represented by James R. Sheatsley of Gorman, Sheatsley & Co. LC in Beckley.
The case has been assigned to Circuit Judge Andrew Dimlich.
