HUNTINGTON — A sales representative is suing an automobile dealer, citing alleged retaliation and wrongful termination.
Thomas Belcher filed a complaint in Cabell Circuit Court against Transportation Network IV, LLC d/b/a Todd Judy Ford of Huntington alleging that it violated the West Virginia law by discharging him because he refused to participate in a fraudulent transaction.
According to the complaint, while an employee of the defendant, Belcher reported fraud while doing a transaction of a customer's credit application that he believed to be in violation of The Truth In Lending Act.
Despite complying with the West Virginia and federal law of having reported a manager's fraud, Belcher was allegedly discharged from employment following his report. As a result, he claims, he suffered lost of income and employment benefits, humiliation and damage to his reputation.
The plaintiff holds Transportation Network IV, LLC d/b/a Todd Judy Ford of Huntington responsible because it allegedly terminated his employment based on his having reported fraudulent conduct in violation of the Truth in Lending Act.
The plaintiff requests a trial by jury and seeks judgment for general and compensatory damages, pre- and post-judgment interest, costs incurred, attorney fees and such other relief as the Court deems fair and proper. He is represented by Hoyt Glazer of Law Office of Hoyt Glazer, PLLC in Huntington.
