Process server claims police threatened her

CHARLESTON — A legal process server is suing a municipal corporation and police officers citing alleged retaliation, intimidation/harassment, intentional infliction of emotional distress, assault, negligent retention and negligent supervision/training.

Tresia Cabell filed a complaint in Kanawha Circuit Court against the City of Dunbar, Adam Mason and Chad Shaffer, alleging that the police officers intimated and harassed her.

According to the complaint, Cabell alleges that on Sept. 25 she was threatened with arrested and to be criminally charged in retaliation against her for serving a federal summons and complaint to Mason. She holds the defendants responsible because the City of Dunbar allegedly negligently retained and supervised its officers, and Mason and Shaffer prevented the service of a federal summons and complaints.

The plaintiff requests a trial by jury and seeks compensatory damages, punitive damages, attorney's fees, costs and other relief the court deems just and fair. She is represented by Mark S. Plants of Plants Law Offices in South Charleston, WV.
