Man claims former Charleston mayor, city ignored FOIA request

CHARLESTON — A Putnam County resident is suing a mayor and a city, citing an alleged violation of West Virginia Code 29B.

Jay Lawrence Smith filed a complaint in Kanawha Circuit Court against former Mayor Danny Jones and the City of Charleston alleging that they deliberately, intentionally and maliciously failed to provide him with records he requested.

According to the complaint, Smith alleges that between Nov. 21 and Dec. 6, 2018, he made an FOIA request regarding an undercover prostitution operation conducted by the Charleston Police Department.

The plaintiff holds Danny Jones and the City of Charleston responsible because they allegedly failed to provide the documents that he requested, a violation of the West Virginia Code 29B-Freedom of Information.

The plaintiff seeks declaratory and injunctive relief, costs of suit and other applicable and further relief the Court deems just and proper. He is representing himself in court.
