BECKLEY — A building contractor is suing a property owner, alleging that the defendant failed to pay for the installation of a new roof.
Alpha Construction filed a complaint against Harvey's Inc. in Raleigh Circuit Court, for $38,080 for work completed. According to the lawsuit, the plaintiff alleges that on June 23, 2017, Alpha Construction was contracted by the defendant to replace the roof of a building situated in or near Skelton, Town District, Raleigh County, W. Va., for $221,990. Despite repeated demands, the suit claims, the defendant has failed to pay the remaining balance of $38,080 under terms of the contract.
The plaintiff holds Harvey's Inc. responsible because the defendant allegedly is aware of its obligation under the contract. The plaintiff seeks an amount of $38,080, pre-judgment and post-judgment interests, costs, attorney's fees and other further relief that the court may find proper and just.
