CHARLESTON — A service technician is suing AT&T Communications, a former employer, citing alleged violation of workers' compensation laws.
Derek Brown filed a complaint in Kanawha Circuit Court against AT&T Communications alleging that it violated the Wage Payment and Collection Act.
According to the complaint, Brown alleges that on Jan. 21, 2014, he was terminated from his employment but did not receive all his wages due within the next four days or by the next regular payday. The plaintiff holds AT&T Communications responsible because it allegedly failed to timely pay all his final wages that were due and payable.
The plaintiff requests a trial by jury and seeks all outstanding wages, liquidated damages, interest, attorney's fees, costs and such other legal and equitable relief. He is represented by Jeffrey A. Foster, Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston.
