Inmate sues, claiming corrections officer sexually abused her

CHARLESTON — An inmate is suing prison authorities, citing alleged civil conspiracy and violation of state and federal law.

Kara Falkner filed a complaint in Kanawha Circuit Court against Nathanial Barkley, the West Virginia Division of Corrections and Rehabilitation and John Doe, alleging that they allowed her to be sexually abused and unsafe while she was incarcerated.

According to the complaint, Falkner alleges that she was sexually exploited by Barkley, a corrections officer for the West Virginia Division of Corrections, and was retaliated against for her complaints.

Falkner holds the defendants responsible because they allegedly had a duty to their inmates to provide a safe confinement facility and to take appropriate measures to ensure that inmates were not subjected to cruel treatment and unusual discipline.

The plaintiff requests a trial by jury and seeks compensatory and punitive damages in an amount to fully compensate her for the damages, plus court costs, attorneys' fees and other further relief the Court may find appropriate.
