Customer alleges Elite Preowned Auto Sales concealed rust, mechanical problems

CHARLESTON – A Dunbar woman alleges a St. Albans used car dealership concealed that the vehicle she purchased had rust and mechanical issues.

Melissa Spitzer filed a complaint in Kanawha Circuit Court against Elite Preowned Auto Sales LLC alleging negligent misrepresentation.

The suit states that the plaintiff purchased a Ford Fusion on Oct. 12, 2018, from the defendant and shortly afterward she began to experience mechanical issues. The plaintiff alleges she found the vehicle had extensive rusting that she had not been warned about prior to the purchase. She alleges she was told that "nothing was wrong with the car" when she purchased it.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michael M. Cary of Cary Law Office PLLC in Charleston.

The case has been assigned to Judge Tod Kaufman.
