CHARLESTON – Charleston attorney Michael M. Cary has scored a judgment against Bank of America in a debt collection case.
Cary filed the case last year on behalf of plaintiff Brock Burwell against the world’s second largest banking company over alleged illegal debt collection practices.
In January, the bank admitted its actions and extended an offer of judgment. Burwell accepted the settlement offer days later along with a commitment from the bank to pay attorney fees. Terms of the settlement were not disclosed.

“This is a monumental win for my client, and for West Virginians who may be facing similar issues with illegal debt collection practices,” Cary told The West Virginia Record. “Bank of America’s practices were a violation of the law, and I’m proud to have represented the plaintiff in holding them accountable.
“This case is just one example of how local attorneys are making a difference in the fight for justice. I will continue to advocate for consumers, protect their rights, and ensure that large corporations are held accountable for their actions.”
Cary is founder of Cary Law Office in Charleston. Bank of America was represented by Elizabeth Thomas of McGuire Woods in Charleston. The case had been assigned to Circuit Judge Tera Salango. Heather Heiskell Jones served as the mediator in the case.
