Buyers allege Buick vehicle has defects, seeks to revoke acceptance of vehicle

CHARLESTON — A Charleston couple allege a new vehicle they purchased has defects that have not been repaired by the dealership or the manufacturer despite attempts.

Marc Roberts and Tammy Roberts filed a complaint in Kanawha Circuit Court against General Motors LLC and Moses Cadillac Buick GMC Truck Inc. alleging breach of implied warranty of merchantability and breach of express written warranty.

The suit states that the plaintiffs purchased a 2019 Buick Enclave from the defendant dealership on Jan. 11. They allege after the purchase, the plaintiffs noticed that there were defects with the vehicle. The defendants have allegedly failed to repair the defects in the vehicle despite the vehicle being under warranty.

The plaintiffs seek to revoke acceptance of the vehicle, attorney's fees and court costs. They are represented by David K. Hendrickson and H. Jerome Sparks of Marc Roberts and Tammy Roberts in Charleston.

The case has been assigned to Judge Tera Salango.
