ABC Landscaping & Excavation says deed was not executed for property it purchased

CHARLESTON — A Kanawha County company has filed a suit against a law firm and another business over the transaction of a property.

ABC Landscaping & Excavation Inc. filed a complaint in Kanawha Circuit Court against Mato Investments LLC and Metz Law Office PLLC alleging negligence.

The suit states that the plaintiff purchased a property in September 2015 for $50,000 and sent a check to Mato. It alleges it was entitled to a those to be served with notice to redeem, but was not provided it. The plaintiff alleges Mato has not executed the deed and/or cashed the check and did promise to return them.

The plaintiff alleges it retained Metz to secure the transaction, but Metz never tended payment to Mato to secure the transfer of the property.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by D. Adrian Hoosier II of Hoosier Law Firm PLLC in Charleston.

The case has been assigned to Judge Carrie Webster.
