Woman hit by motorized shopping cart accuses Kroger of negligence in lawsuit

CHARLESTON – A Charleston woman who was struck from behind by a motorized shopping cart filed suit against Kroger, alleging negligence.

Karen B. Westfall filed the complaint in Kanawha Circuit Court against Kroger Limited Partnership.

Westfall was at the Kroger at 500 Delaware Ave., Charleston, on Aug. 5, 2017, when a customer driving a motorized shopping cart ran into her, injuring her, the lawsuit said. The plaintiff alleges the defendant created a risk of letting customers operate the motorized cars without adequate training, supervision or safety measures.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Travis E. Ellison III of John R. Mitchell Jr. LC in Charleston.

The case has been assigned to Judge Joanna Tabit.
