BECKLEY – An insurance company is suing a Virginia masonry company over allegations it failed to perform adequate work and failed to work on schedule during a project in Beckley.
Steadfast Insurance Co. filed a complaint in Raleigh Circuit Court against JP Masonry Inc. alleging breach of contract and other counts.
The suit states that the defendant was contracted with another party to perform work on the Beckley Intermodal Gateway Project in Beckley on Jan. 10, 2011. The defendant allegedly breached the contract and failed to stay on schedule on multiple occasions. The defendant allegedly also did an inferior job of the work it was contracted to do.
The plaintiff alleges the defendant failed to respond and cure its default and its contract was terminated. The plaintiff alleges it suffered damages as a result.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by J. Philip Fraley of Litchfield Cavo LLP in Barboursville.
The case has been assigned to Judge H.L. Kirkpatrick.
