CHARLESTON — A former Walmart employee says she was wrongfully terminated.
Wal-mart Stores East and three individuals, Wendy Acord, April Tyree and Eric Nemeth were all named as defendants in the suit.
Shelby Edelman was employed at Wal-mart from Feb. 9, 2016, until March 15, 2019, and worked in the Garden Center, according to a complaint filed in Kanawha Circuit Court.
Edelman claims she was diagnosed with chronic fatigue syndrome and an autoimmune disorder and was treated for those during her employment.
During her employment, Edelman made requests for certain things, like bringing a fan from home or having drinking water throughout the day to help negate dehydration and the defendants denied those requests, according to the suit.
Edelman claims she was later fired for allegedly violating the company's absentee policies. She claims she was discriminated against because of her health issues.
Edelman is seeking compensatory and punitive damages with pre- and post-judgment interest. She is represented by Kurt E. Entsminger and Phillip Estep of Estep Entsminger Law Grouo.
The case is assigned to Circuit Judge Charles King.
