Man says Rural King employees falsely accused him of stealing

CHARLESTON — A man claims he was accosted by two Rural King employees when he attempted to leave the store in November.

Jay Folse went to Rural King on Nov. 12 to buy a specific type of shovel, but he was unable to find the product he was looking for and proceeded to leave the store when he was approached by two employees, according to a complaint filed in Kanawha Circuit Court.

Folse claims the employees accused him of stealing and began following him in an aggressive manner as he went to his car.

A deputy then stopped Folse and placed him in the back of his cruiser and went back to the store to review the security footage, according to the suit.

Folse claims the deputy then took him back to his car after he purportedly didn't find any cause for the arrest. Folse claims the defendants' actions caused him outrage and emotional distress.

Folse is seeking compensatory and punitive damages in the amount of $75,000. He is representing himself.

The case is assigned to Circuit Judge Joanna Tabit.
