Peterstown woman sues J.C. Penney for injuries

PRINCETON — A Peterstown woman is suing J.C. Penney for injuries she sustained while entering a store in 2019.

Pamela J. Helvey filed the lawsuit against both J.C. Penney Corporation Inc. and J.C. Penney Properties Inc. alleging that on Oct. 16, 2019, she was entering the second set of double doors leading into J.C. Penney when she slipped in a puddle of water and fell, according to a complaint filed in Mercer Circuit Court.

Helvey claims there were no warning signs or caution signs on the premises and she was in severe pain and unable to move. After she was assisted into a chair, she sought emergency medical care and was required to undergo surgery for her injuries.

The defendants were negligent in allowing the puddle of water to exist on the floor, according to the suit.

Helvey is seeking compensatory damages. She is represented by Brian J. Headly and Jason S. Ballard of Headley Ballard in Pearisburg, Va.
