CHARLESTON — A woman is suing Sunbridge Dunbar Healthcare claiming that her employment was wrongfully terminated.
Diana Elizabeth Daughtry was employed by the defendant beginning in 1988 as a certified nursing assistant and was injured on the job on June 17, 2017, when she was kicked by a resident and had to incur two surgeries, according to a complaint filed in Kanawha Circuit Court.
Daughtry claims she was able to return to full-time work on Nov. 20, 2019, but she was limited to not being around patients or caring for patients. On Jan. 3, 2020, she was informed by her supervisor that her last day would be Jan. 17, 2020, where she was informed she was a liability and that she had been off too long.
The defendant wrongfully terminated the plaintiff's employment and discharged her based on her age. She claims the defendant retaliated against her for filing for workers' compensation benefits after her injury and violated the West Virginia Human Rights Act.
Daughtry is seeking compensatory and punitive damages. She is represented by Michael J. Del Giudice of Ciccarello, Del Giudice & LaFon.
