* Cole and Cockerille purchased a 1994 Mitsubishi 3000 GT on Oct. 26, 2006. They claim within a month it was inoperable and Palmer disputed the warranty. They are claiming he did not follow the Truth in Lending Act, West Virginia Consumer Credit and Protection Act and breached Express and Implied Warranties under Magnuson Moss Warranty Act. They are seeking compensatory damages and statutory damages under the WVCCPA and TILA as well as punitive damages.

* Witteried is seeking a motion of declaratory judgment of challenging Article 15.15 ordinance legality. He is seeking declaration of judgment following dismissal without prejudice of write of certiorari of O6-C-425, claiming that Motion 1 and Motion 6 have not been resolved. He is challenging the legalities of ordinance amendments from Nov. 3, 2003.

* Smith is seeking a declaration of judgment. He entered into a sales contract agreement with Accounting Practice on Dec. 6, 2006. He sent a written cancellation of its services on Jan. 20, 2007, and was notified of termination on March 6, 2007. Smith wants the sales contract's void enforced.
