Wayne woman sues over wreck on 152

WAYNE – A Wayne woman has filed suit against the driver who she says failed to yield the right-of-way and crashed into her.

Yvonne Brumfield claims she was driving south on W.Va. 152 near Echo on Aug. 9, 2007, when Ruby Alene Carter pulled out of Joel's Branch Road onto U.S. Route 152 into traffic and hit Brumfield.

Because of the accident, Carter suffered physical harm, pain, discomfort, a loss of mobility and mental anguish and incurred medical costs of $4,836.40, according to the complaint filed July 10 in Wayne Circuit Court. In addition, her capacity to enjoy life has been impaired, the suit states.

"According to the accident report completed by Corporal S.A. Maynard of the Wayne County Sheriff's Department, Defendant Ruby Alene Carter was negligent in the operation of the vehicle in that she did not have the right of way," the complaint says.

Brumfield is seeking actual costs and an unspecified judgment, plus pre-judgment interest, attorney's fees and other relief the court deems just.

D. Scott Bellomy of Bellomy and Turner in Huntington will be representing her. The case has been assigned to Wayne Circuit Judge James H. Young Jr.
