Doctor accuses Logal General Hospital of retaliation

LOGAN – An emergency room physician alleges she was terminated in retaliation from her position at Logan Regional Medical Center.

Jennifer Hensley MD filed a complaint July 28 in Logan Circuit Court against Health Care Alliance Inc., Logan General Hospital, Christopher Flanagan DO and Michael Sitler MD alleging breach of contract, retaliation and other counts.

According to the complaint, the plaintiff was employed as an emergency room physician at the Logan Regional Medical Center by the defendants. The suit states that when she was working in the emergency room on March 15 and treating a patient, a "code blue" was called but she did not respond because of her patient's low blood pressure. 

The suit states that on April 6, she was terminated.

 The plaintiff holds Health Care Alliance Inc., Logan General Hospital, Flanagan and Sitler responsible because the defendants allegedly retaliated against her and terminated her employment when she satisfactorily performed her duties as outlined in her contract.

The plaintiff requests a trial by jury, award for all damages, attorney's fees, costs and interest. She is represented by Michael P. Addan and Todd S. Bailess of Bailess Smith PLLC in Charleston. The case has been assigned to Circuit Judge Joshua Butcher.
