Certified nurse assistant alleges wrongful termination from Eldercare of Jackson County

CHARLESTON – A certified nurse assistant alleges he was wrongfully terminated by a Jackson County long-term care and rehabilitation facility.

Ryan Navarro filed a complaint Oct. 6 in Kanawha Circuit Court against Eldercare of Jackson County LLC, Terra Parsons and Jennifer Jeffrey alleging that they violated the West Virginia Wage Payment and Collection Act and the West Virginia Human Rights Act.

According to the complaint, the plaintiff was employed by Eldercare in April through September 2016 as a certified nurse assistant. He alleges he was wrongfully terminated because he refused to overbill Medicare/Medicaid and for other actions.

The plaintiff also alleges that he was terminated because he did not share the Christian religious beliefs of the defendants and that the defendants also failed to pay him under the terms of his contract.

The plaintiff requests a trial by jury and seeks damages, plus interest, attorney's fees and witness fees and all other legal of equitable relief. He is represented by Erica Lord of Lord Hoosier PLLC in Charleston. The case has been assigned to Circuit Judge James C. Stucky.
