CHARLESTON – A tenant at a South Charleston apartment building alleges the disrepair of a set of stairs caused her to fall.

Myrna Annette Schneider filed a complaint Oct. 19 in Kanawha Circuit Court against Parsons Bros. Property Group LLC, James A. Parsons Sr. and William H. Parsons Jr. alleging negligence.

According to the complaint, tenants of the four-unit apartment building where the plaintiff resided only had one access and egress point with a set of stairs. The plaintiff alleges that beginning in the fall of 2015, she and other residents notified the defendants that the stairs were in disrepair but nothing was done.

The plaintiff alleges that on July 1, 2016, upon returning from work and while attempting to enter her residence, she fell on the stairs and sustained injuries.

The plaintiff holds Parsons Bros. Property Group LLC, James A. Parsons Sr. and William H. Parsons Jr. responsible because despite having knowledge of the deterioration of the dangerous condition, defendants allegedly failed and refused to fix or remedy such condition.

The plaintiff requests a trial by jury and seeks judgment against defendants, jointly and severally, for compensatory and punitive damages, costs and expenses and all other relief as the court may deem just. She is represented by Claude S. Smith III of The Law Offices of Claude S. Smith III in Charleston. The case has been assigned to Circuit Judge Joanna Tabit.
