Patient accuses Charleston Area Medical Center, ex-wife of invasion of privacy

Medical malpractice 07

CHARLESTON – A Logan County man alleges his medical records were accessed by his ex-wife without permission.

Brent Varney filed a complaint Oct. 23 in Kanawha Circuit Court against Charleston Area Medical Center and Angela Varney alleging negligence, invasion of privacy and other counts.

According to the complaint, the plaintiff received treatment at the Charleston Area Medical Center in March 2016. He alleges his ex-wife Angela Varney, who was an employee of the medical facility, unlawfully accessed his medical records without his permission or consent.

The plaintiff holds Charleston Area Medical Center and Angela Varney responsible because CAMC allegedly failed to develop or implement adequate systems to safeguard its patients' personal information.

The plaintiff requests a trial by jury and seeks actual, compensatory and punitive damages, plus interest, costs, attorney's fees and any further relief that the court may deem fair and proper. He is represented by Hoyt Glaser of Law Office of Hoyt Glazer PLLC in Huntington. The case has been assigned to Circuit Judge Carrie L. Webster.
