CHARLESTON – A Charleston couple claims that their loan servicer invaded their privacy and misrepresented the amount that was due.

Gregory Maynor and Lori Maynor filed a complaint Nov. 8 in Kanawha Circuit Court against Select Portfolio Servicing Inc. and John Doe alleging assault, invasion of privacy, misrepresentation/fraud and breach of contract.

According to the complaint, Gregory Maynor entered into a loan modification with SPS and made payments on a timely basis. The plaintiffs allege that the defendants began trying to collect "vast sums" from them and the defendants falsely claimed the plaintiffs were $100,000 over due. The suit states DPS sent a collection agent to the property in October.

The plaintiffs holds Select Portfolio Servicing Inc. and John Doe responsible because the defendants allegedly threatened use of force against them, physically invaded their personal home and misrepresented amounts that were due that were not.

The plaintiffs seek appropriate damages and equitable relief. They are represented by Daniel F. Hedges of Daniel F. Hedges Law Office in Charleston.
