Man alleges Apex Energy Service failed to pay discharged employees in a timely manner

WHEELING – A former Apex Energy Service employee alleges the company failed to pay discharged employees within the time period mandated by state law.

Robert F. Wallace filed a complaint on behalf of individually and on behalf of all others similarly situated, filed a complaint Jan. 23 in Ohio Circuit Court against Apex Energy Service LLC alleging that the employer violated the West Virginia Wage Payment and Collection Act.

According to the complaint, the plaintiff alleges that on Aug. 19, 2017, he was involuntary terminated from his employment from the defendant and did not receive all wages due to him on the next regular payday. 

The plaintiff holds Apex Energy Service LLC responsible because the defendant allegedly failed to pay its discharged employees all wages due within the periods mandated by law.

The plaintiff requests a trial by jury and seeks award for all damages, including liquidated damages, plus interest, attorneys' fees and costs. He is represented by Todd S. Bailess and Rodney A. Smith of Bailess Smith PLLC in Charleston and Jason E. Causey of Bordas & Bordas PLLC in Wheeling. The case has been assigned to Circuit Judge David J. Sims.
