Former employee alleges mining company failed to pay full wages

CHARLESTON — A former employee has filed a class action lawsuit against a Kentucky mining corporation operating in Kanawha County, alleging violation of workers compensation acts.

William D. Craddock, individually and on behalf of all others similarly situated, filed a complaint March 2 in Kanawha Circuit Court against Blackhawk Mining LLC, alleging violation of the West Virginia Wage Payment and Collection Act.

According to the complaint, on Oct. 23, 2017, Craddock was terminated from his employment at Blackhawk but he did not receive all wages due to him on next pay period. 

The plaintiff alleges Blackhawk Mining failed to pay its discharged employees within the time period as mandated by the WPCA.

Craddock seeks trial by jury, actual and punitive damages, plus interest, attorney fees and court costs. He is represented by attorneys Rodney A. Smith and Todd S. Bailess of Bailess Smith PLLC in Charleston.
