Tech support specialist alleges retaliatory discharge

CHARLESTON — A Kanawha County woman is suing an employer and supervisor, alleging disability discrimination, retaliation and wrongful termination.

Raegan O'Dell filed a complaint in Kanawha Circuit Court against TRG Customer Solutions Inc., doing business as Ibex Global Solutions, and Matthew Loudermilk, alleging violation of the West Virginia Human Rights Act.

According to the complaint, O'Dell was terminated from her employment immediately upon her return to work April 2, 2016 following a serious illness. O'Dell says she has suffered lost wages and benefits, indignity, embarrassment and emotional distress. 

The plaintiff alleges the defendants failed to provide reasonable accommodation for her illness and retaliated against her and terminated her for requesting accommodation.

O'Dell seeks trial by jury, compensatory and punitive damages, plus interest, attorney fees, costs and all other remedies as allowed by law. She is represented by attorneys Jeffrey A. Foster and Todd S. Bailess of Bailess Smith PLLC in Charleston.
