Woman sues Kanawha Valley Regional Transit Authority for injuries

CHARLESTON — A woman who was injured while riding on a public bus is suing the Kanawha Valley Regional Transportation Authority for her injuries. 

Nittaya Gallagher was on a public bus on two occasions — April 10, 2019, and June 19, 2019 — and claims on both occasions, the driver failed to operate the bus in a reasonable manner and was driving erratically, according to a complaint filed in Kanawha Circuit Court.

Gallagher claims she fell onto the floor on the bus and suffered injuries to her knees, shoulder and back that required her to seek medical treatment and surgery.

"The bus driver's negligence proximately caused...Gallagher to fall to the floor of the bus on each occasion resulting in injury," the complaint states.

Gallagher is seeking compensatory damages with pre- and post-judgment interest. She is represented by Scott H. Kaminski of Kaminski Law in Charleston.

The case is assigned to Circuit Judge Joanna Tabit.
