Duster Trucking alleges client owes more than $100,000 for coal hauling services

CHARLESTON – A Scarbro coal hauling company is suing a Chesapeake client who has allegedly failed to pay more than $100,000 for services.

Duster Trucking Co. LLC filed a complaint in Kanawha Circuit Court against Tyler Morgan LLC alleging breach of contract.

The suit states that the plaintiff agreed to provide services to the defendant in 2014 in return for payment. The plaintiff alleges it provided the services and submitted monthly invoices to the defendant, but the defendant would not make full payments or payments were late or missed. The suit states the defendant stopped making payments in February 2018 and the plaintiff alleges it is still owed the balance of $103,530.62.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Nathan D. Brown of Ferrell & Brown PLLC in Williamson.

The case has been assigned to Judge Louis Bloom.
