Property owner alleges McCloy Construction failed to honor guarantee with settlement repair

CHARLESTON – The owner of a Charleston property alleges a construction company has failed to honor its guarantee and has failed to repair settlement issues around the property.

Luke S. Farley filed a complaint in Kanawha Circuit Court against McCloy Construction Co. Inc. alleging negligence and breach of contract.

The suit states that the plaintiff purchased a Charleston property from Teresa L. Baggett in 2011, who said that there had been some settlement issues with the property but that the defendant had repaired the issues. The plaintiff alleges Baggett also supplied a document from the defendant that stated the work had a lifetime guarantee. 

The plaintiff alleges there has been additional settlement issues and he has asked that the defendant honor its guarantee and repair the property or pay the plaintiff for the damages. He alleges the defendant has failed to make the repairs as required.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Michael J. Del Guidice of Ciccarello, Del Guidice & Lafon.

The case has been assigned to Judge Jennifer Bailey.
