Driver files suit against Waste Management, employee over Weirton collision

NEW CUMBERLAND – An Ohio woman alleges the negligence of a Waste Management driver caused a collision in Weirton.

Yvonne Chester filed a complaint in Hancock Circuit Court against David Casto, Waste Management Inc. and Waste Management of West Virginia Inc. alleging negligence.

The suit states that on May 18, 2017, the plaintiff was driving a 2010 Dodge Journey east on U.S. Route 22 in Weirton and Casto was also driving a 2006 Mack truck east on the same road. The suit states Castro was negligent when he changed lanes, striking the plaintiff's vehicle and resulting in damages to her car and injuries. The suit states Casto was an employee of Waste Management and was operating one of its trucks.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Kevin M. Pearl of Frankovitch, Anetakis, Simon, Decapio & Pearl LLP in Weirton.

The case has been assigned to Judge David Sims.
