Driver injured in Nitro accident caused by insecure load seeks damages from Moles Dozer Service

WINFIELD – A Buffalo woman is suing two companies over an incident with an unsecured load that led to her vehicle being struck in Nitro.

Shannon Renee Angell filed a complaint in Putnam Circuit Court against Moles Dozer Service Inc. and J.A.T. of Fort Wayne Inc. alleging negligence.

The suit states on March 29, a Moles employee negligently operated a vehicle in Nitro and failed to yield to the right of way and also failed to properly secure its load. The suit states the load came loose, entered Interstate 64 east at the exit 44 ramp and obstructed the lanes of traffic. 

The suit states the load caused J.A.T.'s vehicle to strike another vehicle stopped in the roadway, which in turn struck the plaintiff's vehicle. The plaintiff alleges she was injured and her vehicle was declared a total loss.

The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Scott H. Kaminski in Charleston.

The case has been assigned to Judge Phillip Stowers.
