CHARLESTON – An inmate alleges he was assaulted by correctional officers while at a Moundsville facility.
Shane Peck filed a complaint in Kanawha Circuit Court against Correctional Officers John Cox, Aaron Lattner, Robbie Sellers, John Doe and West Virginia Division of Corrections and Rehabilitation alleging assault and battery, intentional infliction of emotional distress, liability and other counts.
The suit states that the plaintiff was an inmate at the Northern Correctional Facility and was subjected to abuse and excessive force. He alleges that pepper spray was used on him while he was handcuffed and shackled in his cell and placed in a restraint chair for three hours. He alleges he was injured and he was denied medical treatment. A date of the alleged incident was not provided in the complaint.
The plaintiff alleges the assault and battery caused mental anguish, embarrassment and humiliation.
The plaintiff is seeking all reasonable sums due, attorney fees and court costs. The plaintiff is represented by Paul E. Stroebel of Stroebel & Johnson PLLC in Charleston.
