Son files wrongful death suit against Rockin Chair Residential Care over mother's treatment

PRINCETON – A Bluefield man has filed a suit against a Lerona assisted living facility where his late mother resided over allegations of wrongful death.

According to the filing in Mercer Circuit Court, plaintiff Ricky Dobbs, as administrator of the estate of Lona M. Dobbs, filed suit against Rockin Chair Residential Care Inc., doing business as Rockin Chair Residential Care LLC, alleging negligence and wrongful death. 

The suit states Lona Dobbs was admitted to the defendants' facility in December 2017. Dobbs alleges his mother suffered dehydration and a fractured humerus that developed into adhesive capsulitis in her shoulder, which led to septic shock and death. Dobbs alleges Rockin Chair failed to provide his mother with proper supervision to prevent falls and injuries as well as delayed proper treatment. He also claims the assisted living facility failed to provide his mother with basic needs.

Dobbs seeks damages and attorneys' fees. He is represented by Jeff D. Stewart, Andrew L. Paternostro and S. Andrew Stonestreet of Charleston.

The case has been assigned to Circuit Judge Derek Swope.
