Ohio man alleges intoxicated individuals at Club Inn Between caused broken foot

HUNTINGTON – An Ohio man is suing a Huntington establishment alleging that he was attacked by a group of drunk individuals while there.

Devon Albrecht filed a complaint in Cabell Circuit Court against D.P.M. Inc., doing business as Club Inn Between; D.P.M. owners Roger Muth and Dan Muth Jr.; and Muther LLC alleging premises liability and negligence.

The suit states that the plaintiff was a patron of the club on Feb. 11, 2018, when he was attacked by a group of intoxicated people and was injured. The plaintiff alleges he sustained a broken foot, pain and emotional suffering.

The plaintiff alleges the defendants failed to keep the premises in a safe condition.

The plaintiff is seeking compensatory damages, attorney fees and court costs. The plaintiff is represented by Michael M. Cary of Cary Law Office PLLC in Charleston.

The case has been assigned to Judge Alfred Ferguson.
