Flagger files suit against Fast Cast, driver after cement chute struck head on job site

CHARLESTON – A Dunbar woman is suing a driver of a cement truck who allegedly struck her with the cement chute on a job site.

Terri Ruth Davis filed a complaint in Kanawha Circuit Court against Fast Cast Inc., doing business as Rumble Ready Mix, and Does 1-11 alleging negligence.

The suit states that Doe 1 was employed as a traffic control flagger on Aug. 16, 2017, on a Cross Lanes job site. She alleges she held up her stop paddle to defendant Doe One, who was driving a Fast Cast cement truck, but he failed to obey her and instead drove past her. She alleges the defendant's negligence caused the truck's cement chute to hit her in the head and throw her to the ground. She alleges her head and cervical spine were injured.

The plaintiff is seeking actual, compensatory and punitive damages; interest; and court costs. The plaintiff is represented by Charles R. Webb of The Webb Law Center PLLC in Charleston.

The case has been assigned to Judge Tod Kaufman.
