Fort Gay resident sues town over repeated flooding of basement with raw sewage

WAYNE – A Fort Gay resident is suing a town for damages after her basement was flooded several times with raw sewage.

Sedonia Wilhite filed a complaint in Wayne Circuit Court against the town of Fort Gay, West Virginia alleging negligence and breach of contract.

The suit states since August 2016, the defendant's sanitary sewer system has periodically flooded her basement with raw sewage. She alleges it has occurred five times and other neighboring structures have reported the same issue.

The plaintiff alleges the defendant has not corrected the problem despite repeated requests for repairs or modification.

The plaintiff is seeking all reasonable sums due for compensation, attorney fees and court costs. The plaintiff is represented by Scott D. Maddox of Maddox Law Office PLLC in Huntington.
